21-year-old Diego Cruz Alonso, involved in charges of gang-raping a 17-year-old minor in 2015, was brought before the Third Judge of the First Instance of Veracruz after his extradition from Spain yesterday after remaining seven months in the European country by drawing on his Mexican and Spanish nationality.

Cruz Alonso refused to respond to the judge’s interrogations and adhered to 20th article of the Constitution, thus presenting his declaration on writing. Additionally, he requested the extension of the constitutional term for his lawyers to present rebuttal evidence.

At the end of the judicial process, Cruz Alonso was taken to Plata Linda Penalito’s facility where he will remain until the end of the constitutional term to have his legal status confirmed.

For his part, Javier Fernández, father to the victim, requested an order for formal prison for Cruz Alonso “I hope that the legal process is met accordingly and that he receives the order for formal prison during the next hours, nothing more”, he noted.

Diego Cruz is one of the four people involved in the gang-rape against a 17-year-old minor in 2015, when the victim was attacked in a luxurious mansion of the Costa de Oro neighborhood. The case went viral, and the indicted were named Los Porkys de Costa Oro in reference to a first case that took place ten years earlier, where the children of state public officers and businessmen beat a youth to death in capital city of Xalapa in Veracruz.

In this occasion, the correspondent judge found elements of alleged guilt against three of the indicted: Enrique Capitaine, Diego Cruz Alonso and Jorge Cotaita Cabrales.

Enrique Capitaine was arrested in Torreón, Coahuila, in May 2016 and remained in Amatlán de los Reyes facility until yesterday, where he had his order for formal prison revoked due to inconsistencies in his arrest process.
